Peak Season Surcharges: Exact Cutoff Dates & How to Dispute

Third-party logistics providers (3PLs) routinely charge holiday peak surcharges ranging from $0.40 to $1.50 per order. While legitimate during Q4 holiday volume spikes, billing these fees outside contracted dates is a 100% refundable billing error.

1. Standard Industry Calendar for Peak Surcharges

Major parcel carriers (FedEx, UPS, USPS, DHL) and 3PL networks implement temporary "demand surcharges" to handle peak holiday parcel volumes. In standard fulfillment agreements, these surcharges are strictly governed by explicit calendar windows:

Permitted Holiday Window
Oct 15 – Jan 15
Surcharges allowed if explicitly detailed in rate cards.
Prohibited Off-Season Window
Feb 1 – Sep 30
100% prohibited. Any peak fee billed is a hard overcharge.

2. Why Off-Season Peak Fees Occur on 3PL Invoices

In over 80% of cases, off-season peak surcharges are not malicious fraud—they are the result of ERP configuration inertia:

3. How to Calculate Your Potential Refund

Audit your monthly billing detail lines:

Total Peak Refund = Sum of all "Peak / Demand / Holiday Surcharge" line items where Order_Date is between February 1 and September 30.

For a DTC merchant shipping 5,000 orders per month with an erroneous $0.85 peak surcharge running through April, this equals a $12,750 overcharge.

Subject: Billing Dispute — Unauthorized Peak Surcharge Fees (Account [Your Account Name])

Dear [Account Manager Name],

During our routine monthly invoice reconciliation, our automated audit flagged unauthorized peak season surcharges applied to orders fulfilled outside the contractual holiday window.

According to our fulfillment agreement Schedule B, Peak Demand surcharges are strictly restricted to shipments occurring between October 15 and January 15. However, our [Month] invoice ([Invoice Number]) contains peak surcharges totaling $[Total Amount] across [X] orders fulfilled between [Start Date] and [End Date].

Please review the attached itemized discrepancy ledger and issue a credit memo for $[Total Amount] to be applied against our next billing cycle.

Thank you for your prompt resolution.

Best regards,

5. Warehouse Counter-Arguments & How to Rebut

3PLs sometimes respond that "carrier network surcharges remained in effect." Your response should stand on contract law:

"Our merchant agreement specifically requires 30 days prior written notice before any out-of-cycle rate modification or off-peak carrier surcharge pass-through can take effect. As no written amendment was executed, all off-cycle fees remain unapproved."
